By downloading, accessing, or using the Hngr application or services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, please do not use our services.

These terms apply to all users of the service, including customers, restaurant partners, and delivery drivers.

2. Description of Service

Hngr is a food delivery platform that connects users with local restaurants and delivery drivers. Our services include:

• Online food ordering from partner restaurants
• Delivery coordination through independent contractors
• Payment processing and rewards program
• Real-time order tracking and notifications
• Customer support services

3. User Accounts

Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One account per person; shared accounts are not permitted

Account Responsibilities

• Keep your login credentials confidential
• Notify us immediately of any unauthorized account use
• Update your information to keep it current and accurate
• You are liable for all activities that occur under your account

4. Orders and Payments

Placing Orders

• Orders are subject to restaurant availability and delivery area
• Prices and availability are subject to change without notice
• We reserve the right to refuse or cancel orders
• Special requests may not always be accommodated

Payment Terms

• Payment is required at the time of order placement
• We accept major credit cards and digital payment methods
• Additional fees may apply (delivery, service, taxes)
• Refunds are subject to our refund policy

Cancellations and Refunds

Order cancellations may be possible before restaurant preparation begins. Refunds will be processed according to our refund policy and may take 3-5 business days to appear on your account.

5. Rewards Program

• Earn points with eligible purchases
• Points can be redeemed for delivery fee discounts
• Points expire after 12 months of inactivity
• Rewards program terms may change with notice
• Points have no cash value and are non-transferable
• Account closure results in forfeiture of all points

6. Delivery Services

Delivery services are provided by independent contractors. Estimated delivery times are approximate and may vary based on:

• Restaurant preparation time
• Driver availability
• Weather conditions
• Traffic and distance
• Order volume during peak times

We are not liable for delays beyond our reasonable control.

7. User Conduct

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Use automated systems to access the service
• Impersonate another person or entity
• Harass, abuse, or harm other users, restaurants, or drivers
• Post false or misleading reviews
• Violate any applicable laws or regulations

8. Intellectual Property

The Hngr platform, including all content, features, and functionality, is owned by Hngr and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or logos without authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

9. Privacy and Data

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

Our platform may integrate with third-party services (payment processors, mapping services, etc.). Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, content, or practices of third-party services.

• Merchantability and fitness for a particular purpose

• Uninterrupted or error-free operation
• Food quality, safety, or preparation standards

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HNGR SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from food quality or delivery delays
• Actions of restaurant partners or delivery drivers
• Technical failures or security breaches

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Hngr, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, violation of these terms, or infringement of any rights of another party.

14. Termination

We may suspend or terminate your account at any time for:

• Violation of these terms
• Fraudulent or illegal activity
• Abuse of the service or other users
• Extended periods of inactivity

You may delete your account at any time through the app settings. Upon termination, your right to use the service ceases immediately.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hngr operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

16. Changes to Terms
